1. Accounts and authorized use
Customers are responsible for authorized users, accurate account information, appropriate role assignments, and safeguarding credentials. Users must comply with applicable law and the published acceptable-use restrictions.
2. The service
FoundationOS provides grantmaking, award, nonprofit, CSR, employee-impact, reporting, and related workflow tools. Features may evolve. Material contract commitments, implementation scope, and any service levels belong in an order form or separate written agreement.
3. Customer data
The customer retains ownership of data it submits to FoundationOS. The customer grants Fundamentl the limited rights needed to host, process, transmit, back up, and display that data to provide, secure, support, and improve the service. The customer is responsible for having a lawful basis to submit and process the data.
4. Confidentiality
Each party will use reasonable care to protect the other party’s nonpublic information and use it only for the service relationship. Confidentiality does not cover information that is public without breach, independently developed, rightfully received from another source, or required to be disclosed by law.
5. Acceptable use
- Do not break access controls, probe or disrupt the service, distribute malware, or access another organization’s data.
- Do not use FoundationOS for unlawful discrimination, fraud, harassment, or decisions prohibited by law.
- Do not submit data you are not authorized to process or use automated traffic that harms service availability.
6. Third-party services
FoundationOS relies on managed providers for hosting, authentication, storage, email, analytics, and optional AI functions. Their availability and processing are subject to their services. Current categories and providers are described in the Trust Center and security materials.
7. Fees and orders
Commercial terms are provided in an order form or other written agreement after product fit and scope are established. Unless an order states otherwise, taxes are the customer’s responsibility and payment obligations are non-cancelable for the committed term.
8. Intellectual property and feedback
Fundamentl and its licensors own FoundationOS, its software, documentation, design, and service-generated materials other than customer data. Feedback may be used to improve the service without transferring ownership of customer data.
9. Suspension and termination
Fundamentl may restrict access when reasonably necessary to address security threats, unlawful use, nonpayment under an order, or material breach. On termination, export and deletion are handled under the applicable agreement and Data Management notice.
10. Disclaimers and liability
Except for commitments in an executed agreement, the service is provided on an “as available” basis. FoundationOS does not replace legal, tax, accounting, compliance, or professional advice, and AI-generated output requires human review. Liability allocation, warranty terms, governing law, and dispute terms should be stated in the executed customer agreement.
11. Contact and changes
Questions may be sent to support@fundamentl.app. We may update these Terms as the service changes. Material updates will receive a new effective date and, when appropriate, notice to customers.
